These Terms and Conditions (“the Terms and Conditions”) govern your use of the Bella Bohemia website located at the domain name www.bellabohemia.co.za (“the website”).

These Terms and Conditions govern the supply of any product or service ordered by you on the website.  By ordering a product or service, you agree to be legally bound by these Terms and Conditions.

You agree to take full responsibility for any actions under your Username that occur on the Website or in connection with it, and you are in charge of protecting the confidentiality of your Username and Password. You are not permitted to access the website under a false identity, including that of another user or a third party.

Changes To These Terms and Conditions

At Bella Bohemia's exclusive discretion, this Website may be discontinued, suspended, and updated with or without previous notice to you. You agree that Bella Bohemia will not be liable to you in the event that it decides to suspend, modify, or discontinue this Website.

Usage of our website is solely at your own risk.  No express or implicit promises or representations of any kind are made by us. We do not guarantee that the website's features will operate without interruption or errors, or that the website or the server that hosts it are free of malware or other potentially harmful elements. To the fullest extent permissible by law, we disclaim all responsibility for any direct, indirect, incidental, special, or consequential loss or damage of any kind resulting from access to or use of our website or from the purchase of any of our goods or services.  To the fullest extent permitted by law, you agree to hold us harmless from any loss or damage resulting from your actions or those of any third party acting on your behalf in connection with your use of our website and/or your purchase of any goods or services, as well as any liability incurred as a result of such actions or omissions. While we use secure services and encryption technology where we deem appropriate to protect the security of any information you input or send to us in connection with our service, we accept no responsibility or liability for any damages that you may suffer as a result of the confidentiality of such information being compromised.

Governing Law

The User agrees to the jurisdiction of the Magistrate Court of the Republic of South Africa (Gauteng, Pretoria) in the event of any dispute, which shall be regulated by the laws of the Republic of South Africa.

Prices

The prices listed on this website are valid only in South Africa and are quoted in South African Rands, inclusive of Value Added Tax (or "VAT").  Delivery fees are not included in the prices.

Although we have done our best to display all products and prices as accurately as possible, there is a chance that they will occasionally change or become unavailable. 

We reserve the right to discontinue or change the specifications of our products and services from time to time without notice.  Bella Bohemia shall in no way be held responsible for any errors or misstatements emanating from this website.

Bella Bohemia will not be held liable for an accidental and obvious inaccuracy in a published price unless it has (a) fixed the problem with the price and (b) made all necessary attempts to inform clients of the problem and the correct price.

Rentals

  • Quotations are valid for seven days.
  • An order is only confirmed once 50% deposit is received.
  • Full payment is required before installation/dispatch of goods, unless otherwise arranged with Bella Bohemia.
  • Daily rates will be charged on all late returns.
  • All equipment hired is the responsibility of the customer from the time of completion of installation to the time of collection.
  • Any loss or damage of the equipment will be for the account of the customer.
  • A 50% cancellation fee will be charged on cancellations of accepted quotes.

Colours

We've tried our best to represent the colours of the products on our website as closely as we can. The colours of our products displayed on this website, however, might appear different on your computer than they do on the actual product. This is due to the fact that various computers' displays of colours vary based on the type of computer screen (LCD, plasma, desktop, laptop etc.). We can't promise that your monitor will accurately show any colour.

Stock Availability

Despite the fact that all products are shown on the website, there is no assurance that there is stock.  Please feel free to call us to check availability.  Bella Bohemia will not be held liable for products displayed on the website that are out of stock even though we try our best to keep our website up to date.

Exclusions

The price displayed does not include any mattresses, scatter cushions, linen, or other items that may be featured in the photographs. Mattresses and other items like pots, baskets, and other décor are priced and offered for sale individually.

Many goods are sold or delivered in pieces, along with instructions for assembly.

Fees for assembly and delivery are not included in the displayed price.

Unless our assembly service (where available) is chosen when checking out online, products will be delivered unassembled.

Terms And Conditions of Sale

A contract between you and Bella Bohemia is created when you click the "Pay" button during the checkout process on the Website.  You will receive an email containing all orders placed with Bella Bohemia.

Whenever you make a purchase, you consent to our terms and conditions.

At any time, we reserve the right to stop delivery, decline to accept an order, or decline providing the requested products to the customer.  We further retain the right to impose limits on orders or bulk purchases at our discretion.

Privacy Policy

We value and take your privacy seriously.

 

Bella Bohemia will maintain the utmost confidentiality with regard to the private information needed to carry out orders placed through the e-commerce facility, including the User's personal information, credit card information, delivery address, and telephone numbers. Bella Bohemia will not sell or otherwise make this information known to third parties.  To the third parties delivering the product, only the relevant information, namely, the delivery address and contact phone number, will be disclosed.  Under no circumstances does Bella Bohemia retain credit card information.

 

The User's electronic device (Personal Computer or other electronic device used to browse the Website) may experience security breaches due to inadequate virus protection software or spyware that the User may unintentionally have installed on it.  Bella Bohemia is not liable for these security breaches.

 

For the purpose of statistics reporting, details about the operating systems, browsers, and IP origins of visitors to this website are gathered.  Other than what users voluntarily provide, no personal information about website visitors is collected. 

 

These details - email addresses and cellphone numbers - will only be used to provide communication and weekly specials and will not be shared with or sold to any outside parties.  You have the option to opt out at any time by replying ‘STOP’ to the SMSes or e-mails that we send you.

 

You agree to hear from us through email or SMS when you sign up for our newsletter or provide your phone number when making an account.  You will always have the option to reject either of these communication methods.

Payment

Your payment for any products ordered online from bellabohemia.co.za is done on the secure Payfast Payment Gateway site which handles all online credit card payments.  Cardholders can view Payfast's security policies by visiting https://payfast.io.

We prescribe to high security and encryption standards meaning you can shop online with peace of mind.  It is also to be noted we take all reasonable security measures to ensure that payment and card details, as well as related confidential information, cannot be accessed by anyone who is not authorised to do so.  All personal information that you provide to us is subject to our Privacy Policy as stated above.

Because we adhere to strict security and encryption guidelines, you may shop online with peace of mind. We take every precautionary security measure within our power to prevent unauthorized access to payment and card information, as well as any linked private data.  All personal information that you provide is subject to our Privacy Policy as stated above. 

Returns

Bella Bohemia agrees to return of products provided that the following provisions shall be applicable.  This Returns Policy forms part of and should be read together with the Terms and Conditions.

 

1. RETURNING PRODUCTS THAT ARE NOT DEFECTIVE:

 

If for any reason you wish to return your product(s), you may do so within 7 days of the products being delivered to you, provided the product/s have not been used, are complete, in their original condition, and sealed in the original packaging.

In this case, the following Terms apply:

  • For products that are not defective, handling charges will be applicable. A discretional handling / administration fee of a minimum of 5% or R70 (Seventy Rand) will be charged. This amount will be deducted off the refund / credit.
  • Due to hygiene reasons all Linen products and Mattresses cannot be returned once used/opened.
  • You are liable for the delivery and collection costs of these products.
  • Bella Bohemia reserves the right to refuse the return of products that have been assembled, partly assembled, or where the original packaging has been discarded.  Return of such products could carry charges at Bella Bohemia’s discretion.

2. RETURNING PRODUCTS THAT ARE DEFECTIVE OR DAMAGED:

 

When a product is delivered damaged:

You have the right to refuse delivery of any product that is visibly damaged upon delivery.  You must provide a brief description of the damage on the delivery note. The driver will take the product/s back with them and return them to Bella Bohemia.  Please contact Bella Bohemia immediately to report this.

 

Damage after delivery:

If damage to a product/s only becomes apparent after delivery, you have 48 hours to report the damage to Bella Bohemia. 

 

3. REFUNDS

Should you be entitled to a refund for any reason as stated above, refunds will be done according to your original method of payment. 

Delivery

  • No goods will be dispatched until payment has been settled in full.
  • The customer will be contacted to arrange a date and approximate time for delivery.
  • We require that the delivery document be signed by the customer once goods have been delivered and inspected to indicate each item has been received in good order.  Bella Bohemia cannot be held liable for any damages that aren't marked clearly on the delivery note.  Please see our Returns Policy above for further details.
  • Deliveries will only be made where there is reasonable access.  It is the customer's responsibility to ensure that items can easily pass through doors, staircases etc. and that old furniture and breakables are removed from the space where the goods are to be delivered.  No furniture will be hoisted up balconies or through windows.  If the customer requests these terms to be ignored, Bella Bohemia will not be held liable for any damage to goods or property.
  • Additional deliveries due to customers missing delivery appointments and/or inaccessible premises may be payable by the customer.

DELIVERY FOR ONLINE PURCHASES

 

We are happy to ship your products to you as soon as possible and at the lowest possible cost because we are aware of how excited you are to receive them.  Due to the size and composition of our items we must take delivery costs into account.

 

FREE DELIVERY

 

Free delivery on orders over R 5,000 in Pretoria.

  • Sorry! We do not currently offer cross-border or international deliveries.
  • * The Delivery charge differs depending on whether you stay in a Main Centre or an Outlying/Regional Area. Delivery charges are calculated at checkout.  Please make sure you enter the correct postal code and an accurate delivery address. 
  • Working days are defined as Mondays to Fridays.  Excludes Saturdays, Sundays and public holidays.
  • Should you place an order and our courier company advises that they do not service this area, we will contact you to advise and arrange, either delivery to the nearest town (if possible) or, a refund. We will always try our best to deliver to your area or as close as we can.
  • Once your order has been processed, you will be contacted to advise when delivery will take place. 
  • MANY PRODUCTS ARE DELIVERED UNASSEMBLED.

  • The threshold for FREE delivery is calculated after any promotions and discounts are applied and does not include any assembly fees.
  • If your area is difficult to reach or outside the free delivery area, we have the right to contact you and let you know that there will be a delivery price and the free delivery promotion does not apply.  You have the option to cancel your order and receive a refund if you don't want to pay this shipping price (provided your order has not already been processed and dispatched).

Cancellation

We understand that plans may change, and sometimes appointments need to be adjusted or cancelled. However, to ensure smooth operations and to accommodate all our valued clients, we have instituted the following cancellation policy:

  1. Notification Period: Clients are kindly requested to provide at least 24 hours' notice for any appointment cancellations or rescheduling requests.
  2. Late Cancellations/No Shows: If an appointment is cancelled with less than 24 hours' notice or if the client fails to show up for their scheduled appointment, a cancellation fee equivalent to 50% of the total service cost will be charged.
  3. How to Cancel: Cancellations or rescheduling requests can be made by contacting us directly via phone or This email address is being protected from spambots.   4. Group Bookings and Special Events: Different cancellation policies may apply to group bookings or special events Please inquire at the time of booking for specific details.

By booking an appointment with us, you agree to abide by the terms of our cancellation policy outlined above.  We appreciate your understanding and cooperation in helping us maintain the highest level of service for all our clients.
